Enforcing Arbitral Awards Before the Kenyan Courts

The narrow construction of the public policy ground has been reaffirmed in successive decisions, and applications to set aside awards on the merits are consistently refused.

Award creditors should nonetheless plan enforcement carefully, particularly where assets are held through corporate structures.

Careful drafting of the arbitration clause, including seat, rules, and language, remains the most effective protection against enforcement risk.
